CBD Companies Patiently Wait For Rules And Regulations From FDA And Congress
According to FDA Commissioner Stephen Hahn, CBD products are here to stay. FDA is working on creating rules around allowing businesses to sell CBD-based foods and supplements. However, without congressional action, it could take a long time. Hahn believes that if the researchers present them detailed information, it will help them make better decisions faster.
Hemp and its derivatives have been federally legal in the U.S. since the passage of the 2018 Farm Bill, but policies governing the marketing of CBD have been murkier.
After Congress started removing limitations of hemp cultivation, except three states, every other state has sent their plans to the USDA to regulate hemp production.
Senate Majority Leader Mitch McConnell wants to create a regulatory framework for CBD products. However, the agency did not send in a report before the deadline, but then they are known to leave these things till the last minute.
On the other hand, Congress is taking actions to regulate hemp-derived CBD, such as by allowing cannabinoid to be marketed and sold as a dietary supplement. At the recent agriculture event, a USDA undersecretary mentioned that the agency will be postponing a requirement and later, said that they are temporarily suspending the enforcement of this rule.
