As The Industry Awaits The FDA Still Has Some Decisions To Make Regarding CBD Regulations
While cannabis itself is illegal in the US, CBD-based products are legal since hemp and derivatives were made legal in 2018. FDA does not accept CBD products as food derivatives and has always been cautious about allowing companies to market these products. Stephen Hahn, FDA Commissioner, believes that banning is not the solution here. Instead, developing safe products and marketing them correctly is the right way to go. For that, the agency is now working to create rules so that food companies will be able to market CBD as a dietary supplement.
Due to the lack of proper rules and approvals from the FDA, CBD products aren’t readily available. Cannabis and food companies aren’t able to market and sell the products freely in the US.
Last month, the FDA missed a deadline for submitting an update on the development of enforcement guidelines for CBD products but soon after, provided one to the Congress. It would soon be against the rules to make unsubstantiated claims about the therapeutic effects of CBD products. As of now, the FDA is still working to understand how hemp extracts are derived and how they can be useful to us. With the demand for medical cannabis rising fast, the FDA will have to make a decision soon.
