Legal Hemp Causes Confusion On Marijuana Arrests In Nebraska. One Solution Would Be To Just Legalize It.
Last year, industrial hemp was legalized in Nebraska and it had some unplanned consequences. Since medical and recreational marijuana remains illegal in Nebraska, the state senators twined-in a way into the law to efficiently differentiate the legal crop from marijuana. This law will restrict the amount of THC in the plants grown or transported in the state. This law could complicate some marijuana arrests. Colfax County Attorney Denise Kracl asks…
…”if someone gets pulled over with marijuana, how do we know what the THC content is, of the drugs that we seize, if we aren’t able to test them this is hemp, or this is marijuana?” It takes sophisticated technology to measure the chemical content.
The local lab has already handled nearly 2,000 tests of the confiscated drugs in 2020. With so much work, the results can take up to three months before delivered back to local law enforcement.
Due to resource allocation, testing would not be done for infraction level plant material cases. To work out a way to deal with this, small counties are paying for the testing themselves instead of relying on the state-funded labs. The law enforcement has to let charges drop against those dealing with small quantities since they could not put together a case without lab tests, especially with the fines so low. If the fines were higher, it would be worth to test this and call witnesses etc.
